Liability Waiver, Release & Indemnity Agreement

This Liability Waiver, Release, and Indemnity Agreement (the "Waiver") is executed by the undersigned participant in favor of Signature Scuba Singapore Pte. Ltd., Signature Scuba Group Lombok, Thamarind Resort, Melati Resort Gili Gede, their directors, officers, instructors, divemasters, employees, boat captains, land transport drivers, and corporate affiliates (collectively, the "Released Parties").

I explicitly acknowledge that participating in open-water scuba diving, advanced technical deep diving exploration, reef monitoring operations, snorkeling excursions, boat transit, island cycling, horseback riding, Cidomo carriage transit, surfing activities, and land-based mainland trekking involves inherent, unavoidable dangers.

These risks include, but are not limited to: decompression sickness, barotrauma, drowning, marine animal encounters, changing weather patterns, rough seas, equipment malfunctions, currents, uneven terrain, physical exhaustion, falls during land activities, and limited availability of immediate remote medical treatment.

I voluntarily choose to participate in these activities with full knowledge of these risks and assume all physical and financial responsibility for any injury, loss, illness, or damage sustained.

I hereby release, waive, and forever discharge the Released Parties from any and all liability, claims, demands, or causes of action arising out of negligence, breach of contract, or statutory duty of care.

I agree that neither Signature Scuba Singapore Pte. Ltd. (acting as the digital e-commerce distributor and Merchant of Record) nor Signature Scuba Group Lombok (including its affiliate resorts such as Thamarind Resort and Melati Resort Gili Gede acting as the physical on-site service operators) shall be held legally or financially responsible for any personal injury, property damage, accidental death, or emotional distress resulting from my participation in any diving or non-diving activities marketed through this platform.

I warrant that I am physically fit, mentally competent, and have honestly completed the required Medical Declaration Form.

If I am a certified diver, I certify that I hold a valid physical or digital certification card from an internationally recognized agency (SSI, PADI, or equivalent) and will adhere strictly to safe diving limits, technical diving protocols, and buddy guidelines.

This Waiver shall be governed by, and construed in accordance with, the laws of the specific jurisdiction where the physical incident occurred (Republic of Indonesia) regarding on-site operations, while transactional, payment, and merchant processing disputes shall be governed exclusively by the laws of the Republic of Singapore.

If any portion of this Waiver is found invalid by a court of law, the remaining clauses shall continue in full force and effect.
